Marketplace terms

These Marketplace Terms govern buyer registration, use of draixcor.com and purchases from DRAIXCOR Direct or an identified third-party professional seller. “Platform” means draixcor.com and its account, messaging, review, returns and marketplace functions; “buyer” means a user acting as a consumer or business customer; “seller” means the trader identified for a listing and order.

Nanjing Siluhuacheng Technology Co., Ltd. operates the Platform. It is the seller only for offers marked “DRAIXCOR Direct”. For a marketplace offer, the named third-party trader is the seller and contracting party for the goods. Mandatory consumer rights always prevail over conflicting wording in these Terms.

A buyer account is intended for persons with legal capacity. A minor may use the service only through, or with valid consent from, a parent or legal guardian where permitted by law. Registration requires a valid email address, truthful and current information, an email confirmation and acceptance of the version of these Terms shown at registration.

The account is personal. Keep the password secret, do not allow unauthorised use and notify draixcor@163.com promptly if access may be compromised. You remain responsible for activity you authorised; this does not make you responsible for unauthorised activity caused by a security failure attributable to DRAIXCOR. The accepted Terms version, language and timestamp are recorded with the account. Marketing consent is separate and optional.

You must not use the Platform unlawfully, provide false identity or order data, infringe another person’s rights, manipulate reviews or advertising, scrape protected data, introduce malicious code, bypass access controls, interfere with the service, or use another person’s account. Product questions, complaints and safety reports must be made in good faith.

DRAIXCOR may restrict a function, listing or account when reasonably necessary for security, fraud prevention, legal compliance, product safety or a material breach. Where appropriate, we give reasons and a route to challenge the decision. Immediate action may be taken where delay would create legal, safety or security risk. Existing order, refund, statutory claim and data-access rights are not cancelled merely because an account is restricted.

The product page, basket and order confirmation identify the seller. DRAIXCOR Direct orders are sold by the Platform operator. Marketplace orders are sold by the named professional seller; DRAIXCOR supplies the technical marketplace, account, message, compliance and escalation services and is not automatically a party to that sales contract.

A basket containing more than one seller may create separate contracts, payments or allocations, invoices, shipments, returns and refunds. The seller remains responsible for its product information, delivery, conformity and after-sales duties. DRAIXCOR retains its own legal duties as platform operator and may intervene for safety, moderation, payment coordination and customer-care escalation.

A listing is an invitation to submit an order unless it expressly states otherwise. Before the final order, the buyer can review seller identity, essential product characteristics, total price, VAT treatment, delivery restrictions, available payment methods and correct input errors. A binding order is submitted only through a button clearly stating the obligation to pay.

The automated receipt confirms that the order reached the Platform but is not necessarily acceptance. The sales contract is formed when the responsible seller expressly accepts the order or dispatches the goods, as stated in the confirmation. The seller may reject before acceptance for unavailability, failed payment, legal or safety restrictions, or an obvious pricing or description error. Any captured amount for a rejected item must be released or refunded without undue delay.

Consumer prices are displayed in euros and include VAT where the listing says so. Delivery charges and every unavoidable additional cost known at checkout are shown before the buyer orders. For cross-border or business purchases, tax treatment may depend on destination and validated status; the final order record controls.

Only payment methods displayed at checkout are available. Payments are handled by the provider identified during checkout and may be subject to that provider’s authentication and fraud checks. DRAIXCOR does not require a buyer to provide an API key for any manual shop or account function. Card or wallet credentials are not stored by DRAIXCOR unless a future payment feature clearly states otherwise.

Stock and delivery estimates are updated with reasonable care but become binding deadlines only when expressly agreed. The seller may propose a partial shipment or substitute only with the buyer’s agreement. If performance becomes unavailable, the buyer is informed and affected payments are refunded. The buyer must provide a complete delivery address and may bear reasonable repeat-delivery costs caused solely by an incorrect address after prior notice.

The seller remains responsible for delivery to the agreed place. For consumers, risk normally passes only when the buyer or a nominated third party takes physical possession, except where mandatory law provides otherwise. Tracking events are informational; loss, damage or non-delivery should be reported through the order so the responsible seller and DRAIXCOR can investigate.

Consumers retain all mandatory rights where goods do not conform to the contract, including repair or replacement and, where the legal conditions are met, price reduction or termination. Limitation periods and burdens of proof follow the mandatory law applicable to the order. A manufacturer or seller guarantee is additional and cannot replace or reduce statutory rights.

For goods with digital elements or digital products, the responsible trader must provide and communicate updates, including security updates, for the period required by applicable law and the reasonable expectations created by the product and contract. A buyer should install properly notified updates; liability can be affected only under the conditions allowed by mandatory law.

An eligible consumer normally has 14 days to withdraw from a distance contract without giving a reason. The separate Withdrawal & Returns notice explains the start of the period, refund, return costs, diminished value and legal exceptions and forms part of these Terms. Any advertised 30-day return service is voluntary and never shortens statutory rights.

Where German law requires it, the Platform provides a continuously accessible online withdrawal function labelled clearly, followed by a confirmation step and an immediate receipt on a durable medium. A buyer may also use the order return route or email a clear statement. The seller shown on the order is the withdrawal recipient; DRAIXCOR routes and logs the request.

The account and help centre let a buyer contact DRAIXCOR Direct, the responsible marketplace seller or the Platform. Each case shows the assigned party and keeps one shared history so the buyer does not have to repeat the problem. DRAIXCOR may access and retain case communications where necessary to route, supervise, investigate, refund, resolve safety issues or prevent abuse.

Sellers must not require buyers to move mandatory service, return, complaint or safety communication off the Platform. A buyer may still use the published email address or any legally required method. Electronic confirmations, order records and case messages may be stored as evidence and made available to the buyer, subject to privacy and legal retention rules.

Reviews must reflect a genuine experience and must not contain unlawful, misleading, abusive, confidential or third-party-infringing content. Incentives, if any, must be disclosed. A review may be labelled as verified when the Platform can link it to a completed purchase; the label is not an endorsement of the opinion.

By submitting content, the user grants DRAIXCOR a non-exclusive, worldwide, royalty-free licence to host, reproduce, translate and display it only for operating, moderating and promoting the Platform and the relevant product. DRAIXCOR may restrict content under transparent moderation rules, preserve evidence and provide a complaint route. The user keeps ownership of their content.

Before a third-party trader can sell, DRAIXCOR may obtain and verify its identity, address, contact details, register number, payment account and compliance self-certification. Sellers must provide accurate product identifiers, manufacturer and EU responsible-person details, warnings, instructions, CE or other markings where required, VAT and EPR information, and evidence requested for the destination market.

DRAIXCOR may pause or remove an offer, freeze a payout, order a recall workflow, notify buyers and cooperate with authorities when a product may be illegal, unsafe or non-compliant. Product-safety reports can be made through customer care. These controls do not transfer the seller’s legal responsibility to the buyer and do not exclude DRAIXCOR’s own duties under the DSA, GPSR or other applicable law.

Nothing excludes or limits liability that cannot lawfully be excluded, including liability for intent, gross negligence, death or personal injury, product liability, fraud, a guarantee assumed, or mandatory consumer rights. For ordinary negligence, liability may be limited only to breach of an essential contractual duty and foreseeable, typical loss to the extent permitted by law.

DRAIXCOR is not responsible for failures caused solely by the buyer’s device, connection or unauthorised modifications. A seller remains liable for its sales contract. Parties are not liable for delay caused by an event genuinely outside reasonable control, but the affected party must inform the other, mitigate the effect and preserve statutory cancellation, refund or delivery rights.

DRAIXCOR, seller and manufacturer names, content, software, designs, images and databases remain protected by their respective rights. Buyers receive only a limited, non-transferable right to use the Platform for lawful personal or internal business purchasing. Automated extraction, resale, republication or commercial reuse requires permission unless law expressly permits it.

The service requires a current browser, internet access, JavaScript and essential storage for account or basket functions. Maintenance and security updates may temporarily affect availability. DRAIXCOR uses reasonable care but does not promise uninterrupted service; planned changes must not remove rights already acquired under accepted orders.

A buyer may request closure through account support at any time. Closure ends access to optional account functions but does not cancel accepted orders, payment, delivery, return, warranty, safety or legal-claim duties. Information that must be retained by law or to establish, exercise or defend claims is restricted and retained for the applicable period.

DRAIXCOR may terminate an inactive or materially breaching account after reasonable notice where practicable. The buyer can request a copy of available order and case records. Re-registration after a safety or fraud suspension may be refused where necessary and proportionate.

Personal data is processed under the separate Privacy & Cookie Notice, which identifies the controller, marketplace data flows, purposes, legal bases, recipients, international transfers, retention, rights and current storage technologies. Acknowledging that notice is not consent to optional advertising or analytics.

Essential storage may be used to provide a requested account, basket, security or consent-choice function. Optional analytics or personalised advertising may be activated only after a valid choice and can be withdrawn without affecting the contract or basic service.

DRAIXCOR may update these Terms for legal, security, service or marketplace changes. Material changes affecting an existing account are communicated in a durable form with reasonable notice and the effective date. A buyer may close the account before the change takes effect if they do not accept it.

A change does not retroactively alter an order already accepted unless the buyer expressly agrees or mandatory law requires it. The version accepted at registration or checkout and the applicable order terms remain recorded.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, without depriving an EU consumer of mandatory protection under the law of their habitual residence. Courts are determined by mandatory procedural law; no exclusive venue is imposed on consumers.

DRAIXCOR is not currently willing or obliged to participate in proceedings before a German consumer arbitration board unless a mandatory rule or a seller-specific disclosure states otherwise. The former EU Online Dispute Resolution platform is not linked because it was discontinued on 20 July 2025.
